The terms that govern your use of the Tech Ops application.

This End User License Agreement (“Agreement”) is a legal agreement between you (“you”) and EMC Horizons LLC (“EMC Horizons,” “we,” “us”), a Pennsylvania limited liability company, governing your use of the Tech Ops application and related services (the “App”). By downloading, installing, or using the App, you agree to this Agreement. If you do not agree, do not use the App. If you use the App on behalf of an organization, you represent that you are authorized to accept this Agreement for that organization.
Subject to this Agreement and any applicable subscription, EMC Horizons grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for your internal business purposes. We reserve all rights not expressly granted.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Accounts are for a single user; do not share credentials. Notify us promptly of any unauthorized use.
Some features require a paid subscription (including per-seat and AI add-on plans). Plan details, trial terms (including any free trial), and pricing are presented at sign-up and on our website. Unless purchased through an app store's in-app purchase system, subscriptions are billed by EMC Horizons through our payment processor and renew until cancelled. Where you purchase through an app store, that store's billing and cancellation terms also apply. Fees are non-refundable except as required by law or expressly stated.
You retain ownership of the data and content you submit to the App (“Your Content”). You grant EMC Horizons a limited license to host, store, process, and transmit Your Content solely to provide and support the App. You are responsible for Your Content and for having the rights to submit it. Our handling of personal information is described in our Privacy Policy.
You agree not to:
The App, including its software, design, text, graphics, and the “Tech Ops” and “EMC Horizons” names and logos, is owned by EMC Horizons and protected by intellectual-property laws. Except for the license granted above, this Agreement gives you no rights in the App or our intellectual property. Feedback you provide may be used by us without obligation to you.
The App integrates third-party services (for example, payment processing, AI, and mapping providers). Your use of those features may be subject to the third parties' terms, and we are not responsible for third-party services.
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The App is an operational tool and is not a substitute for professional judgment or for any legally required safety, security, fire, or regulatory system or certification; do not rely on it as such. We do not warrant that the App will be uninterrupted, error-free, or secure, and you are responsible for maintaining your own backups of important data. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the maximum extent permitted by law, EMC Horizons will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the App. Our total liability for all claims relating to the App will not exceed the greater of the amounts you paid to us for the App in the twelve (12) months before the claim, or USD $100. These limitations apply even if a remedy fails of its essential purpose.
You will indemnify and hold harmless EMC Horizons from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the App, or your breach of this Agreement.
This Agreement applies while you use the App. We may suspend or terminate your access if you breach this Agreement or to protect the Service. You may stop using the App at any time. On termination, your license ends and you must stop using the App; sections that by their nature should survive (for example, ownership, disclaimers, liability limits, and indemnification) will survive. Handling of your data after termination is described in our Privacy Policy.
We may release updates, and some updates may be required to keep using the App. Features may change, be added, or be removed over time. The App is under active development.
This Agreement is governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws rules. The courts located in Pennsylvania will have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court.
We may update this Agreement from time to time. When we do, we will change the “Last updated” date above. Your continued use of the App after an update means you accept the revised Agreement.
The following terms apply when you obtain the App from the Apple App Store and control over EMC Horizons' terms only to the extent required by Apple:
When you obtain the App from Google Play, your use is also subject to the Google Play Terms of Service. This Agreement governs your use of the App itself, as between you and EMC Horizons.
